Limitation of liability

IN NO EVENT WILL PAUL GOLD OR IT’S AFFILIATES BE LIABLE FOR ANY CLAIM OF ANY NATURE, WHETHER DIRECT OR INDIRECT, ARISING FROM OR RELATED TO (I) CONTENT MADE AVAILABLE ON OR THROUGH THE SERVICE, INCLUDING ERRORS OR OMISSIONS IN SUCH CONTENT, OR PRICE INFORMATION BY REASON OF NON PERFORMANCE OR INTERUPPTION OR TERMINATION THEREOF (II) ANY LOSS OR DAMAGE ARISING DIRECTLY OR INDIRECTLY OUT OF DECLINE OF AUTHORIZATION FOR ANY TRANSACTION ON ACCOUNT OF THE CARDHOLDER HAVING EXCEEDED THE PRESENT LIMIT MUTUALLY AGREED BY US WITH OUR ACQUIRING BANK FROM TIME TO TIME.

PAUL GOLD OR IT’S AFFILIATES SHALL NOT BE LIABLE FOR ANY CLAIM OF ANY NATURE, WHETHER DIRECT OR INDIRECT, ARISING FROM OR RELATED TO DURABILITY OF GOLD INCLUDING WEIGHT TOLERANCE OF THE PRODUCT.

ANY PRODUCT OR SERVICE MADE AVAILABLE THROUGH THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.

Cancellation/Refund

If you wish to cancel the order, you have an option of cancelling it only before the product is dispatched / shipped. Once your order is dispatched the option of cancelling the same shall not be provided to you.

However, you/ customer has two (2) options to redeem the amount paid, if the purchased product is still not dispatched:

• Customer can transfer the paid amount to Paul Gold “Wallet” and use the paid amount at any time (same or later) for purchase of any product, as listed on the website, of the same amount or higher amount.
• In case the product purchased is of a lesser amount the same can be possible, but in such a scenario the balance amount shall be available in the Wallet. The customer / you shall have an option to purchase any another product as listed and also have a right to redeem the balance amount present in the wallet.

If you wish to take the entire refund the same can be refunded to in your bank account as provided by you after deducting 2 percent of paid amount. The refund shall be available within a period of ten (10) working days after receiving the refund request.

*Balance amount-Paid amount minus next purchased product amount

*Paid amount-Actual amount paid by the customer

In such a case, where 2 or more orders items are purchased by you, all items shall carry single order number with separate bar codes/Id numbers.

If you wish to cancel any product within the same order number the same can be done provided the cancellation is done only before the products are dispatched.

You agree and undertake that as per our policy you will not be entitled for refund or exchange once the products are dispatched/shipped.

This refund facility shall be available only through www.paulgold.in and shall not be provided through other marketing locations or any sister concern branches of Paul Gold in India.

Unlawful Activity

Paul Gold reserves a right to block your account or take any action if the Company deems appropriate, including but not limited to reporting any suspected unlawful activity to law enforcement officials, regulators, or other third parties and disclosing any information necessary or appropriate to such persons or entities relating to your Account profile, email addresses, usage history, posted materials, IP addresses and traffic information.

Indemnify

You agree to indemnify and hold us and our subsidiaries, affiliates, officers, agents, and employees, harmless from and against all losses, demands, claims, damages, expenses (including reasonable legal costs) and liabilities arising from any third party claim resulting from the use or misuse of Paul Gold Products and / or Services or for harm suffered directly or indirectly by us as a result of your breach or non-compliance of obligations under this Agreement.

Confidentiality

Paul Gold shall ensure to keep all the data shared by you be kept confidential. You agree that the following information shall not be subject to such confidentiality: (a) information that is or will be generally known to the public (provided that such information does not result from the receiving party’s unauthorized disclosure to the public); (b) disclosure of such information is required by applicable laws or security exchange rules.

Force Majeure

Any delays in or failure of performance by Paul Gold under this Agreement shall not constitute default hereunder if and to the extent caused by Force Majeure, which is defined to be occurrences beyond the control of the party affected, including but not limited to acts of the government authorities, acts of God, fire, flood, explosion, riots, war, rebellion, insurrection, sabotage and non-cooperation of third parties.

Governing Law

Notwithstanding anything to the contrary contained herein, any legal controversy or legal claim arising out of or relating to this Agreement shall be governed and construed in accordance with the law of India, the Courts in Chandigarh shall have an exclusive jurisdiction to determine any dispute arising out of or in relation to this Agreement.
